The lawsuit between 23XI Racing, Front Row Motorsports, and NASCAR is scheduled for December 1st. Before that, there has been an ongoing legal battle among the parties. The teams were granted a preliminary injunction to keep their charters during the lawsuit, but this decision was recently overturned by the Fourth Circuit Court of Appeals in Richmond, Virginia. The courts ruled that the teams cannot benefit from parts of the 2025 Charter Agreement they agree with while suing NASCAR over parts they disagree with. Despite the teams requesting a rehearing with the entire Fourth Circuit Court of Appeals, their appeal was denied on July 9th. It is uncertain what options the teams have left, but they may lose their charters within a week, leading them to bring their cars as open entries to Dover Motor Speedway. This situation will result in financial losses, voided contracts, and uncertainty over the fate of the charters they currently hold.
